The right to own and control property is the cornerstone to a free society. In America we pride ourselves on our Constitutionally protected rights and our high percentage of property ownership. Ownership, however, implies the ability to exercise, at a minimum, some degree of dominion over our lands and our homes. But is there any truth to that perception? How free are we to determine the use of what we own?

On The Commons with me this week is Mark Ferran. Mark, a prolific writer on the subject of property rights and a land owner, has been working hard to protect his property from trespassers. While his problems do not arise out of the usual homeowner association issues, his ordeal to protect himself, his family and his land is just as important.
